Client Agreement
Regulation
Lansdown Place is trading style of Lansdown Place Financial Management Ltd which is authorised and regulated by the Financial Services Authority and bound by the rules of such. The firm’s Regulated Identification is 126762 and you can visit the FSA website to check all of the following details, or contact them on 0845 606 1234
Investment
Lansdown Place is authorised to advise on and arrange Life Assurance, Pensions, Investments in authorised Collective Investment Schemes, Unit Trust PEP’s and ISA’s, Mortgages and associated insurance products. Lansdown Place is an independent financial advisory service, and we therefore act on behalf of our clients advising you on products from the whole of the market place. We will always establish exactly what your needs and objectives are prior to providing you with any advice; this is normally completed with the use of what we call a fact finding questionnaire. We can also advise you on non regulated products; however, we will always make it explicitly clear that this is the case and advise you of your rights.
We Do Not Handle Clients Money
We never handle cash and will not accept a cheque made out to us, unless it is a cheque in settlement of an invoice we have sent to you for charges or disbursements
Insurance Services
Lansdown Place is permitted to advise on and arrange non-investment insurance contracts. Lansdown Place will advise you on products from a range of insurers based on a fair analysis of the market.
Lansdown Place offers advice in accordance with that disclosed to you in our Initial Disclosure Document. Occasions may arise where we or one of our other clients have some form of interest in business being transacted for you. If this happens, or we become aware that our interests or those of one of other clients conflict with your interests, we will write to you with details of our interest and obtain your consent before we carry out your instructions, and detail the steps we will take to ensure fair treatment.
Payment for Services
We normally derive our income from commission paid to us by life assurance companies and the operators of collective investment schemes through which investments are made.
Alternatively, if you or we propose to operate on a fee basis, we will agree its structure, frequency and method with you in writing before we carry out any chargeable work. Should we receive commission from any third party in relation to transactions arranged for you, we will offset the amount received against any fees due.
Accounting to You
Unless in exceptional circumstances, we will confirm to you in writing the basis of our reason for recommending any advice or transaction executed on your behalf. We will forward to you all documents relating to your ownership of your investments as soon as is practical after receiving them
We hope that you will never have cause to complain regarding our services and advice to you, however should you need to do so we are members of the Financial Ombudsman Service, further details of which can be found on our Keyfacts ‘About our Services’.
We are also members of the Financial Services Compensation Scheme. Again, further details regarding this can be found on our Keyfacts document.
Termination of Authority
You, or we, may terminate our authority to act on your behalf at any time, without penalty. Notice of this termination must be given in writing and will take effect on the day of receipt. Termination is without prejudice to any transactions already initiated which will be completed according to these terms of business unless otherwise agreed in writing. You will be liable to pay for any transactions made prior to termination and any fees which may be outstanding
Right to Cancel
In the case of a non packaged product ISA or PEP recommended we will inform you in writing of any right to withdraw or cancel, or, if it is the case we will inform you that no such rights exist. You are advised that because investments can fall as well as rise, you may not get back the full amount invested. Past performance is not necessarily a guide to future performance. Because of the risk factors involved with any form of investment it is imperative that we clarify with you what your tolerance to investment risk and reward is. We will do this by the completion of a questionnaire and a full discussion with you where we will clarify and confirm the level of risk you are willing to take with your investments
Data Protection
You can be assured that we will keep all of your personal information private and confidential, even when you are no longer a client, except where disclosure is made at your request or with your consent. Under the terms of the Data Protection Act, you have the right to view any personal data we may keep on you.
In order to process an investment on your behalf it may be necessary to disclose some or all of your information to third parties. You agree that personal information held by us may be disclosed on a confidential basis and in accordance with the Data Protection Act 1998 to any such third parties. Some of these parties may hold this information indefinitely. You also agree that this information may be transferred electronically, e.g. e-mail and you agree that ourselves, or any such company, may contact you in the future by any means of communication which we consider appropriate at that time
Client Categorisation
Unless you otherwise instruct Lansdown Place, and the firm concurs with your decision, we will consider you to be a ‘Retail Client’, this means that you will receive the maximum level of protection with regards to the Financial Services Compensation Scheme and that you will be provided with the appropriate level of service.
Consent
I have read carefully the above and consent to the terms outlined above, and I authorise the transfer of information, on a confidential basis when warranted between any such third parties. I acknowledge that this Client Agreement will come into effect from the date of issue and that I am in receipt of the Keyfacts documents – About Our Services and About Our Costs
